Vietnamese national Bui Duc Hien applied for leave to appeal to the Court of Final Appeal against the Court of Appeal's refusal to extend time for his non-refoulement judicial review appeal. The applicant raised arguments that had not been raised before the lower courts, which is impermissible. The Notice of Motion was dismissed.
