RE MD FATTAH AHMED

Bangladeshi applicant Md Fattah Ahmed appealed the refusal of leave for judicial review of the Torture Claims Appeal Board's decision dismissing his non-refoulement claim based on a land dispute with a neighbour. He had entered Hong Kong illegally from the Mainland in March 2020. The Court of Appeal (Kwan VP and Cheung JA) dismissed the appeal, finding the risk was localised and internal relocation was viable.
