RE BUI DINH LAP

Bui Dinh Lap, a Vietnamese national, reapplied for leave to appeal against the refusal of leave to judicially review the dismissal of his non-refoulement claim, after the Judge had refused an extension of time. The Court noted the Judge had miscalculated the deadline by not accounting for summer vacation. Nevertheless, the intended appeal had no reasonable prospect of success and was dismissed.
